Overview

These Terms of Service ("Terms") govern your access to and use of www.reviewboostcard.com (the "Website") and any products or services offered by ReviewBoost Pty Ltd ("ReviewBoost", "we", "us", "our"), including physical NFC review products and the ReviewBoost AI software platform ("Software"). By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Website.

These Terms are governed by the laws of Victoria, Australia and the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth). Nothing in these Terms limits or excludes any rights you have under applicable consumer protection laws that cannot lawfully be limited or excluded.

1. Eligibility

By using this Website, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not prohibited from purchasing our products under the laws of your jurisdiction. If you are purchasing on behalf of a business, you confirm that you have the authority to bind that business to these Terms.

2. Use of the Website

You are granted a limited, non-exclusive, non-transferable licence to access and use the Website for lawful personal or business purposes. You must not:

  • Use the Website for any unlawful purpose or in a way that violates any applicable laws or regulations
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Website without our express written permission
  • Attempt to gain unauthorised access to any part of the Website or its related systems

  • Use automated tools to scrape, crawl, or extract data from the Website

Any unauthorised use immediately terminates the licence granted by these Terms.

  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we believe have been compromised.

4. Products and Pricing

We take care to ensure all product descriptions, images, and pricing on the Website are accurate. However, errors may occur. In the event of a pricing error, we will notify you as soon as possible and give you the option to proceed at the correct price or cancel your order for a full refund.

All prices are displayed in the currency shown on the Website and are inclusive of GST where applicable for Australian customers. International customers are responsible for any customs duties, import taxes, or fees applicable in their country.

Products are subject to availability. If a product becomes unavailable after your order is placed, we will contact you promptly and offer a suitable alternative or a full refund.

Product images are for illustrative purposes only. Actual products may vary slightly from images shown.

5. Orders and Payment

By placing an order you are making an offer to purchase. Your order is accepted when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion.

Payment must be made in full at the time of purchase. We accept payment via Shopify Payments, Stripe, PayPal, and other payment methods displayed at checkout. All payment processing is handled by our third-party payment providers and is subject to their terms and conditions. We do not store your full payment card details.

If your payment is declined, your order will not be processed. You are responsible for ensuring sufficient funds and that your payment details are correct.

6. Shipping and Delivery

Orders are processed within 1–2 business days of payment being received. Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or circumstances outside our control.

7. Returns and Refunds

Returns and refunds are governed by our Refund and Return Policy, which forms part of these Terms and is incorporated herein by reference. Your statutory rights under applicable consumer protection law are not affected.

8. ReviewBoost AI Software Platform

Access to the ReviewBoost AI software platform ("Software") is provided subject to the following terms:

  • A free account is available to all customers who purchase a physical product
  • The Pro plan subscription is available at $49.99 AUD per month and includes a 30-day free trial
  • After the free trial period the subscription will automatically renew at the applicable monthly rate unless cancelled prior to the renewal date
  • You may cancel your subscription at any time through your account settings
  • No refund is provided for partial months of service unless required by applicable law
  • We reserve the right to modify subscription pricing with 30 days notice to active subscribers
  • We reserve the right to suspend or terminate Software access for breach of these Terms or for misuse of the platform

9. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, product designs, and software, is the property of ReviewBoost Pty Ltd or its licensors and is protected by Australian and international copyright, trademark, and intellectual property laws. You must not reproduce, modify, distribute, or commercially exploit any content without our express written consent.

The ReviewBoost® name and logo are registered trademarks of ReviewBoost Pty Ltd. Unauthorised use of our trademarks is prohibited.

10. Consumer Guarantees

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that applies under the ACL or equivalent legislation in your jurisdiction that cannot lawfully be excluded, restricted, or modified. Where our liability cannot be excluded, it is limited to the greatest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ReviewBoost's total liability to you for any claim arising from or related to these Terms or your use of the Website or products is limited to the amount you paid for the relevant product or service giving rise to the claim.

ReviewBoost is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, revenue, data, or goodwill, arising from your use of the Website, products, or Software, except where such liability cannot be excluded under applicable law.

We do not warrant that the Website will be uninterrupted, error-free, or free from viruses or other harmful components. We are not responsible for any damage to your device or data resulting from your use of the Website.

12. Third-Party Links and Services

Our Website may contain links to third-party websites or integrate with third-party services. These are provided for convenience only. ReviewBoost is not responsible for the content, accuracy, or practices of third-party websites or services and does not endorse them. Your use of third-party websites is subject to their own terms and privacy policies.

13. Prohibited Uses

You must not use our Website or products to:

  • Violate any applicable local, national, or international law or regulation
  • Engage in any conduct that is fraudulent, deceptive, or misleading
  • Infringe the intellectual property rights of ReviewBoost or any third party
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Collect or harvest personal information from the Website without authorisation

14. Termination

We reserve the right to suspend or terminate your access to the Website or Software at any time without notice if we believe you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our reasonable discretion. Upon termination, your right to use the Website and Software ceases immediately. Termination does not affect any accrued rights or obligations.

15. Dispute Resolution

We encourage you to contact us first at info@reviewboostcard.com to resolve any dispute informally. We will make every effort to resolve your concern within 14 business days.

If a dispute cannot be resolved informally, it shall be referred to mediation in Victoria, Australia before any legal proceedings are commenced. Australian customers may also contact Consumer Affairs Victoria or the Australian Competition and Consumer Commission. UK customers may contact their relevant Trading Standards authority or the UK Online Dispute Resolution service. EU customers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Subject to any mandatory consumer protection laws applicable in your jurisdiction, you submit to the non-exclusive jurisdiction of the courts of Victoria, Australia for the resolution of any dispute.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund and Return Policy, constitute the entire agreement between you and ReviewBoost with respect to your use of the Website and supersede all prior agreements and understandings.

19. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Website following the posting of changes constitutes your acceptance of the updated Terms. We recommend you review this page periodically.
